Tax certificates – New legislation

Since January 1st, 2024, a new legislation regarding tax certificates has been approved. Associations must henceforth provide the National register Number (NN) of all donors who want and are entitled to a tax certificate to the tax authorities*. (PFS Finance Obligation –Article 323/3 CIR92).

The government is thereby intent on ascertaining the identity of donors so as to guarantee that tax benefits are applied in a transparent and correct manner. This data item has thus become mandatory for issuing tax certificates.

The same rules apply for legal entities and companies concerning tax deductions for donations made since January 1st, 2024. The company number (Crossroads Bank for Enterprises [central business register]) must be provided instead of the NN.

Please note that:

Tax certificates for couples are preferably issued to one and in the name of one of the partners, with his or her NN (the deductible amount will be included automatically in the joint tax return).
Most foreign nationals who reside and pay taxes in Belgium have a valid BIS NN [a Social Security Identification Number] for tax form 281.71. Donors concerned can find their BIS number on their Belgian identity card, payslips, tax assessment notice, pension file, etc.

If no donor personal data are known or if a donor wishes to remain anonymous, the tax certificate cannot be issued...
